What Florida decides, for somebody living in a planned community. Everything below is the state's own law, quoted from the sections Sahvelo has read, with the source beside it.
What is different about a community like this
A continuing care retirement community, where an entrance fee and a refund provision are often the largest single asset in the estate.
Whatever the community is called, three things decide what an estate may do with a home in one: the age restriction, the association's recorded documents, and any district assessment that arrives on the tax bill. None of the three is state law and all three bind whoever inherits.

Whether the car needs any of this
Florida is the strictest state in this comparison, and it is strict by omission. There is no transfer-on-death designation for a vehicle, and no vehicle-specific small-estate affidavit of the kind California and New York use. Survivorship between co-owners exists only where the title says so in terms — with right of survivorship, or JTWROS — and without those words two names on a Florida title are tenants in common. What is left goes through the estate, and for most families that means summary administration, whose order is the document the transfer is made on.Source 6Source 7Source 8Source 9

The bank accounts
Whether you can reach the account without a court appointment
No. Florida has no affidavit a family hands across a counter. Both routes end in a court order: summary administration, on a petition filed in the circuit court for the county where the person lived at death, or the narrower disposition without administration for an estate effectively exhausted by the funeral bill and the medical and hospital expenses of the last sixty days of the last illness.Source 1Source 2
How much the no-appointment route covers, and what counts toward it

What you hand the bank
The order. Summary administration produces an order of the circuit court, and that is the document the institution acts on; the narrower route produces the court's authorization to pay or transfer the property to whoever is entitled to it. Whether the bank has to release it, and what protects the bank
Sahvelo has verified no Florida provision compelling a holder to release funds and states none. What it has verified is the outer edge of what the family is waiting out: a claim against the estate that arose before the death is barred 2 years after it, whatever notice was given.Source 5
Who decides the funeral, and what your own wishes do
Who has the legal right to decide, if the family disagrees
Florida ranks the dead person first. Written directions the person gave during life come ahead of every living human being, followed by anyone they named on a Department of Defense record of emergency data if they died in military service. Only then the surviving spouse, an adult son or daughter, a parent, an adult brother or sister, an adult grandchild, a grandparent, and any person in the next degree of kinship.Source 11
What moves somebody up the list, or removes them from it
Florida moves the documents the other way. An attorney in fact or a health care surrogate is reached only where no family member exists or is available — below every relative to the next degree of kinship — so the person a Californian would expect to be first is nearly last here. Disqualification is drawn more widely than in the other three states and does not wait for a charge: an arrest for an act of domestic violence against the deceased, or for any act contributing to the death, removes that person.Source 11Source 12
Two people at the same rank who disagree
The funeral establishment relies on any one member of the class, on that person's own representation that they are not aware of any objection from the same class or from a higher one. It is a representation rather than an investigation, so one sibling's word is enough until somebody has actually made an objection known. That makes telling the establishment, rather than telling the family, the step that matters.Source 12
Whether being the executor decides the funeral
Florida answers this expressly and the answer surprises people: the personal representative is reached only where no family member exists or is available. Being appointed to administer the estate puts a person below every relative down to the next degree of kinship. In practice the timing settles it anyway, because letters usually arrive weeks after the funeral.Source 11
Whether your own written wishes actually bind anybody
Written directions the person gave during their life are the first entry in Florida's priority list, ahead of every living person — so the wishes are not something the family weighs, they are who decides. That is the strongest position of the four states Sahvelo has read.Source 11
Naming somebody now to make these decisions for you
Naming a person achieves comparatively little in Florida, because an attorney in fact or a health care surrogate is reached only where no family member exists or is available. What does work is writing the instructions themselves: the person's own written directions given during life rank first, ahead of everyone.Source 11
What happens when somebody objects after arrangements have begun
Not established. Florida's reliance rule is read and is published above, and Sahvelo has not read a provision governing what happens once an objection is actually communicated after arrangements have started.
If you prepay, what actually protects the money?
The exit. Florida trusts only part of the money — a fraction of services and merchandise, all of cash advances — and gives strong cancellation rights instead. Thirty days to cancel outright for a complete refund, and after that the services, facilities and cash-advance portions may be canceled at any time for a full refund of what they cost. Merchandise is the exception, refundable only where the seller cannot or does not deliver. The 30-day right must be stated in conspicuous type, and failing to state it does not take it away. Refunds are due within thirty days of written notice.Source 13
When driving stops being safe
Who can report an unsafe driver, and whether anybody has to
The only one of the four states read that puts the report in a family member's hands by name. Any physician, PERSON or agency with knowledge of a licensed driver's mental or physical disability to drive is authorized to report it to the Department of Highway Safety and Motor Vehicles, in writing, with the person's name, date of birth, address and a description. Two protections answer the fear that stops most families: no civil or criminal action may be brought against the physician, person or agency who reports — the immunity covers the son or daughter, not only the doctor — and the report may not be used as evidence in any civil or criminal trial or court proceeding at all. It is also exempt from the public records law.Source 14
What can the state do short of taking the license away?
The broadest of the four, and the one that answers what a restriction actually looks like. Beyond mechanical devices, § 322.16(1)(b) lets the department restrict use by TIME and PURPOSE — expressly including intrastate operation only, and any other condition it considers necessary for driver improvement or safety. That is the statutory basis for the daylight-only, no-motorway or within-a-radius license families hear about anecdotally and cannot find in writing. It may also act at any time on a court's recommendation.Source 15
What a divorce does to the documents
Does divorce change the documents by itself?
Yes for divorce, and no for the other two life events people assume revoke a will. Any provision of a will that affects the spouse is VOID on dissolution, whether the marriage came before or after the will. But marrying somebody does not revoke a Florida will, and neither does having a child — the omitted spouse or child takes a statutory share instead, regardless of what the will says. So the will survives and its arithmetic changes.Source 16

Any person 18 or over, for a copy without cause of death. The version showing cause of death is restricted to spouse, parent, child, grandchild or sibling, someone with a documented interest in the estate, their representative, or by court order.Source 20

How fast must the death be registered, and does it hold up the funeral?
Five days after the death, and before final disposition. Florida will also add an alias or 'also known as' name to the certificate if the informant asks — useful where accounts or deeds are in a different version of the name.Source 21

How much notice before cover ends, and what if they are late?
Forty-five days' advance written notice of nonrenewal or of the renewal premium, with reasons — but that duty applies only if the insured has furnished the information the insurer needs to develop the renewal premium. Mid-term cancellation also takes forty-five days with reasons, except that cancellation for nonpayment of premium needs only ten days' written notice.Source 22
The belongings, and who decides
Is a separate list binding?
Yes. A written statement or list referred to in the will disposes of tangible personal property other than property used in trade or business, where the will does not dispose of it specifically.Source 23
What the list itself must be
Signed by the testator — handwriting alone is not enough. It must describe the items and the devisees with reasonable certainty.Source 23
Is there a limit on what the list can give away?

Can it be changed later?
Yes. It may be prepared before or after the will and altered afterwards; where writings conflict, the most recent revokes the inconsistent parts of earlier ones.Source 23

The safe-deposit box
Who can get the box open?
A person named in a court order or, with no order served on the bank, the spouse, a parent, an adult descendant, or whoever is named as personal representative in a copy of a purported will that they produce. The examination happens in the presence of an officer of the bank.Source 24
What may actually be taken out?
Three things only: a writing purporting to be a will, a writing purporting to be a deed to a burial plot or to give burial instructions, and a document purporting to be a life insurance policy on the decedent. The bank copies whatever leaves and files the copy in the box with a memorandum of who took it and when.Source 24
Where does the will end up?
To the court with probate jurisdiction in the county where the financial institution is located — delivered by the bank, not by you. Note that this is the bank's county, which may not be the county where probate will run.Source 24
When can the box actually be emptied?
On presentation of a certified copy of letters of authority, when the bank must immediately grant access and permit removal of any or all of the contents. Where the appointment was made in another state, the bank may wait three months and act at its discretion.Source 25
What if nobody is paying the rent?
Not established. Florida's search and delivery rules are quoted on this page; its unpaid-rent remedy is not one Sahvelo has read.

A second home in another state
What does the second state actually require?
A full ancillary administration. Where a non-resident dies leaving assets, credits due from residents, or liens on property in Florida, ancillary letters are issued in a set order of preference — first to a personal representative specifically designated in the will to administer the Florida property, if qualified to act in Florida; then the foreign personal representative if qualified; then an alternate or successor named in the will who is qualified; then somebody selected by those entitled to a majority interest of the Florida property. On intestacy, Florida's ordinary order of preference applies where the foreign representative is not qualified. The representative gives bond as any Florida personal representative does, proceedings are to be as similar to an original administration as possible, and unless claims are already barred a notice to creditors must be served and published under chapter 733, with unfiled claims barred. The representative may sell, lease or mortgage the local property, and at the end the court may order what is left transferred to the foreign representative or distributed to the beneficiaries.Source 27
Taxes
Whether the state taxes the estate itself
None, stated in terms: a federal change eliminated Florida's estate tax for people who died after 31 December 2004. Since 1 July 2023 the estate does not even file the affidavit saying no tax is due.Source 28
Who the tax is charged to, if anyone
Nobody. Florida's estate tax died with the federal credit it was calculated against, and since 2023 the estate does not even file to say so.Source 28
The thing that catches people
That the absence is genuinely an absence. Executors still file the affidavit that was abolished in 2023, or hold up a closing waiting for a clearance the state no longer issues.Source 28
