What South Carolina decides, for somebody living in a planned community. Everything below is the state's own law, quoted from the sections Sahvelo has read, with the source beside it.
What is different about a community like this
Three things decide what an estate may do with a home in a planned community, and none of them is state law: the age restriction, the association's recorded documents, and any district assessment that arrives on the tax bill. All three bind whoever inherits, which is why an inheritance in a community like this becomes a sale more often than the family expects.
Does an estate here go through probate?
What the simplified route is called
Two routes with the same name and different shapes. The affidavit under section 62-3-1201 collects personal property with no appointment, but South Carolina's is not self-executing: a probate judge approves and countersigns it, and it is filed in the probate court. The summary procedure under section 62-3-1203 is different in kind, happening inside an estate that has already been opened.Source 1Source 2
Where the threshold sits
$45,000 of the entire probate estate, wherever located, less liens and encumbrances, counting property passing under the will plus property passing by intestacy. The summary procedure inside an estate uses $45,000 plus exempt property, administration costs, funeral expenses and last-illness medical expenses, and it has a second door with no figure at all: where the appointed representative is the sole devisee or sole heir, the estate qualifies whatever it is worth.Source 1Source 2
Waiting period before you can use it
Thirty days from the death for the affidavit, with no application for a personal representative pending or granted in any jurisdiction. Two other clocks start without the family: a creditor may seek appointment forty-five days after the death, and the Department of Revenue four months after it.Source 1Source 3
Is there an outer deadline?
Ten years, and what happens at the end of it is not merely a bar on filing. Where no informal probate and no formal testacy proceeding is commenced within ten years of the death, it is incontestable that the decedent left no will and the estate passes by intestate succession. The will stops being an open question. Two shorter clocks sit inside that: a contest of an informally probated will runs eight months from the informal probate or one year from the death, whichever is later, and creditor claims are barred one year after the death against the estate, the representative, the heirs, the devisees and non-probate transferees.Source 4Source 5
Whether the car needs any of this
It depends which of four situations fits, and South Carolina's DMV publishes all four alongside one refusal that catches families: it will not read a will. A transfer on death designation is available on a title with one owner or with owners in an "or" relationship, but not where the ownership is designated as an "and" relationship, and a lien needs the lienholder's written permission before a beneficiary can be added. During the owner's life the beneficiary has no ownership, interest or control, and the property transfers only after all owners have died. An affidavit under section 62-3-1201, and it is a court document rather than a private one. It must be approved and countersigned by the probate judge of the county of domicile, and only on the judge's satisfaction that the successor is entitled to payment or delivery, and then filed in that court.Source 1

Who may use it
A person claiming to be the successor of the decedent, and South Carolina's definition is wider than the word “successor” suggests: successor includes a person who remitted payment for reasonable funeral expenses. So somebody outside the family may be entitled to present the affidavit. Under the DMV's version of the route the vehicle can then be titled only in the name of the person the court appointed or approved.Source 1Source 6
Does it reach a house?
No. The section reaches tangible personal property and the debts owed to the decedent, and the count it uses is of the probate estate rather than of the land. Where real property is in the estate, the route is the summary procedure inside an opened estate instead.Source 1Source 2
If you are the one handling it
Whether you need to be appointed, and how
Appointment is the rule rather than the exception: to hold the powers and duties of a personal representative a person must be appointed by order of the court, qualify, and be issued letters, and administration is commenced by the issuance of letters. Priority runs through eight classes, and two of them are not family — a creditor forty-five days after the death, and a person suitable to the court on the Department of Revenue's application four months after it.Source 3
What proves you can act, and what it is called here
Letters, issued on qualification, and the DMV names the certificate of appointment as the first of three things it wants for a vehicle. Anyone with priority may nominate somebody else into their place, and the nominee takes the same priority, except that a person the testator named outranks a nominee. What you are personally on the hook for
Two ninety-day clocks and a one-year bar. Within ninety days of appointment the representative must prepare an inventory and appraisement of the probate property with a fair market value and any encumbrance for each item, file the original with the court, and mail it to anybody who demanded notice. A second ninety days runs from a demand by an interested person for a list of the NON-probate property, which somebody else starts. Creditors are barred one year after the death, and the bar reaches the estate, the representative, the heirs, the devisees and non-probate transferees. The representative is not liable to any creditor or successor for giving or failing to give notice.Source 7Source 5

What you hand the bank
The countersigned affidavit. The judge signs only on being satisfied that the successor is entitled to payment or delivery, so the approval is substantive rather than clerical.Source 1
Whether the bank has to release it, and what protects the bank
Yes: on the countersigned affidavit the holder shall make payment of the indebtedness or deliver the property. Note who else may be entitled ahead of the family — the definition of successor includes a person who remitted payment for reasonable funeral expenses.Source 1
