What Indiana decides, for somebody living in a planned community. Everything below is the state's own law, quoted from the sections Sahvelo has read, with the source beside it.
What is different about a community like this
Three things decide what an estate may do with a home in a planned community, and none of them is state law: the age restriction, the association's recorded documents, and any district assessment that arrives on the tax bill. All three bind whoever inherits, which is why an inheritance in a community like this becomes a sale more often than the family expects.

What the simplified route is called
The small estate affidavit under IC 29-1-8-1 — and, for a vehicle or watercraft, a shortcut inside it that is a materially different instrument: five days rather than forty-five, two of the six required statements rather than all six, and a bar phrased as no appointment being contemplated rather than none pending or granted. Contemplated is a statement about intention, which is a softer test.Source 1

Waiting period before you can use it

Is there an outer deadline?
Sahvelo has not verified a deadline on opening an Indiana estate and does not assert one either way. The verified Indiana clock runs on the title rather than on the estate, and it is short: 45 days. The statute does not say purchased, it says "or otherwise acquired", which is how an inherited car falls inside it. Where no ordinary form fits and a judge's order is used instead, the Bureau starts the same clock again from the day the order is stamped.Source 3Source 4
Whether the car needs any of this
Yes, but on the lightest paperwork in this comparison: one sworn page, no court, five days, provided the gross probate estate is $100,000 or less. Two traps. A transfer on death designation is void unless the owner signed the title before dying, so a beneficiary printed on the certificate is not enough on its own. And an inherited car is exempt from the seven percent sales tax only while the family does not take over the loan. Being late costs real money: the title is $15, lateness costs twice that, and same-week service is twenty-five dollars more.Source 2Source 5Source 6Source 7

Who may use it
A distributee, or somebody acting on their behalf, who is entitled to take on each distributee's behalf. Indiana adds a duty no other state here imposes: the affiant must already have notified each distributee named in the affidavit of the intention to present it. The vehicle shortcut drops that requirement along with three others, and asks instead that the affidavit be duly executed by the distributees of the estate.Source 1
Does it reach a house?
No. The section reaches personal property and an instrument evidencing a debt, an obligation, a stock or a chose in action, and the vehicle subsection reaches a certificate of title. Land is outside all of it.Source 1
If you are the one handling it
Whether you need to be appointed, and how
Usually not, and the vehicle route is the lightest in this comparison. IC 29-1-8-1(c) moves a certificate of title five days after the death provided no appointment of a personal representative is contemplated, which is a statement about intention rather than the harder test the general route uses. The general affidavit waits forty-five days and requires that no appointment is pending or has been granted in any jurisdiction.Source 1
What proves you can act, and what it is called here
State Form 18733, the affidavit for transfer of a certificate of title without administration, and the Bureau prints its authority on the form itself: IC 29-1-8-1(c). It must be duly executed by the distributees of the estate, and a copy of the death certificate goes with it; the form asks for nothing certified. The vehicle shortcut drops that, which is why it is the lighter document and the riskier one for a family that does not all agree. What it will not do is estimate them.
