Small asset

A single item measured on its own against a ceiling — not the whole estate.

What it means

Some states set their lowest small-estate route on the value of one asset rather than on the value of the estate. Virginia's is written that way: a small asset is one valued at or under the statutory figure, and the test is applied to that asset.

This is the opposite of the ordinary threshold, which counts the entire personal probate estate wherever located.

Why it matters

It changes the arithmetic completely. An estate of three separate accounts can be inside the per-asset section for every one of them and outside the whole-estate section altogether.

It usually comes with a weaker verb. Where the whole-estate route says the holder shall pay, the per-asset route often says may — so the bank is permitted to release the money and is not compelled to.

When you are likely to meet it

  • When a statute speaks of a small asset rather than a small estate.
  • When a bank releases one account and refuses another of the same size.

Only some states measure per asset, and the figure differs where they do.
